Terms of Service

These terms govern your use of Kept, a paid membership that keeps track of the people in your life, tells you when an occasion is coming up, and — with your approval — buys and ships a gift on your behalf. By creating an account, you agree to the terms below.

1. What Kept is

Kept is a membership service. For a flat monthly fee, Kept tracks the recipients, occasions, and preferences you tell it about, and generates gift suggestions ahead of each occasion. When you approve a suggestion, Kept purchases and ships that gift on your behalf, up to the budget you've set.

Kept is not a gift shop or marketplace — you're not browsing a catalog and checking out. You're approving or declining a single recommendation Kept has already made for you.

2. Membership and billing

Your membership is billed monthly at the rate shown on the Pricing page at the time you subscribe. Payment is processed securely by Stripe; Kept never sees or stores your full card number.

Gift costs are billed separately from your membership fee, and only after you approve a specific suggestion. You control the per-person budget that caps what Kept is allowed to spend without a fresh approval.

  • Membership fees are billed automatically each month until you cancel.
  • Gift charges only occur after an explicit approval — by text reply, or in your account.
  • If a payment fails, Kept will notify you and pause gift-related actions until it's resolved.

3. Gift approvals

By default, nothing ships without your explicit YES — by text message or through your account. If you turn on auto-approve for a specific person or type of gift, Kept will proceed without asking each time, up to the limits you've set. You can change or turn off auto-approve at any time in Settings.

You're responsible for keeping your approval settings, budgets, and recipient details accurate. Kept acts on the information and permissions you've given it.

4. Cancellation

You can pause or cancel your membership at any time from your account. Cancelling stops future billing at the end of your current billing period — Kept does not provide refunds for the unused portion of a billing period already paid for.

Any gift already approved and in progress at the time you cancel will still be fulfilled, since that charge was authorized separately from your membership fee.

5. Your responsibilities

You agree to provide accurate account and recipient information, to keep your login credentials secure, and to use Kept only for its intended purpose — personal gift-giving, not resale or commercial use.

6. Termination

Kept may suspend or terminate an account that we reasonably believe involves fraud, abuse, non-payment, or a violation of these terms. Where practical, we'll notify you and give you a chance to resolve the issue first.

7. Disclaimers and limitation of liability

Kept is provided "as is." Gift suggestions are generated from the information you provide and general good judgment — we don't guarantee that any suggestion will be perfect for every recipient.

To the fullest extent permitted by law, Kept's total liability for any claim relating to your membership is limited to the amount you paid Kept in membership fees over the 12 months before the claim arose. Kept is not liable for indirect, incidental, or consequential damages.

8. Changes to these terms

We may update these terms as Kept evolves. If a change is material, we'll notify active members by email before it takes effect. Continuing to use Kept after a change takes effect means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the state in which Kept is operated, without regard to conflict-of-law principles.
